Earlier this year, the Cabinet granted initial approval for the introduction of Zambia’s Access to Information Bill in Parliament. Once enacted into law, this legislation has the potential to be a game-changer, empowering citizens with a newfound ability to access vital information held by public bodies. The History of the Bill in Zambia
Zambia has had a long and complicated history with regard to an Access to Information Bill. The first ATI Bill was drafted in 2002, but was withdrawn from Parliament after failing to pass a second reading. Ten years later, in 2012, the Patriotic Front government established a task force to draft a new ATI Bill. The task force submitted its draft bill to the government in 2013, but it was never introduced to Parliament. In 2016, the Patriotic Front government introduced a new ATI Bill to Parliament, which was criticized by civil society groups for being too restrictive and for failing to meet international standards and was eventually withdrawn from Parliament in 2018. In 2021, the United Party for National Development (UPND) government came to power and promised to enact an ATI Bill. In 2022, the UPND government introduced a new ATI Bill to Parliament that is currently under consideration by Parliament.
The ATI Bill is a particularly controversial piece of legislation in Zambia. Supporters of the bill argue that it is essential for promoting transparency and accountability in government, while opponents of the bill argue that it could be used to undermine national security and to harass government officials.
